DMCA Policy

Sqe Exam respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are reported to our designated Copyright Agent.

It is our policy to remove content that infringes the copyright of others and to terminate the accounts of repeat infringers. We also maintain a counter-notification process as outlined below, allowing users to dispute claims of infringement.

Filing a DMCA Infringement Notice

If you believe that material residing on or accessible through the Sqe Exam website or service infringes a copyright, please send a written notice of copyright infringement containing the following information to our Copyright Agent:

  1. Identification of the copyrighted work claimed to have been infringed: Please provide a detailed description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: Please identify the material that you claim is infringing (or the subject of infringing activity) and that is to be removed or access disabled. Provide information reasonably sufficient to permit us to locate the material, such as the URL(s) of the specific page(s) where the material is found on Sqe Exam.
  3. Your contact information: Provide your full legal name, mailing address, telephone number, and email address.
  4. A statement of good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

DMCA Counter-Notification

If you believe that your content, which was removed or disabled, is not infringing or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notification containing the following information to our Copyright Agent:

  • Identification of the material that has been removed or to which access has been disabled: Please provide the URL(s) of the specific page(s) on Sqe Exam where the material appeared before it was removed or disabled.
  • Your contact information: Your full legal name, mailing address, telephone number, and email address.
  • A statement of good faith belief: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • A statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Sqe Exam may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will send a copy to the original complaining party. If the complaining party does not inform us that they have filed a legal action seeking a court order to restrain you from engaging in infringing activity within 10 business days of receiving the counter-notification, we may reinstate the removed material. Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.
